Exemption: Content Produced by Third Parties

The owners and operators of the website are not the "producers" of any actual or simulated sexually explicit content appearing hereon. The undertakings of owners and operators of the website are limited to the transmission, storage, retrieval, hosting, or formatting of content, which may be sexually explicit, that is contributed by third-party users. All user-furnished content appearing on hairywomen.tv results from the actions of users of the website, who have control of areas of the website that contain the content. The operators of hairywomen.tv are therefore released from compliance with Section 2257 records keeping and labeling obligations as established in 28 C.F.R. §75.1(c)(4). Any content on hairywomen.tv that is believed to contravene the terms of use or other policies of the website will be deleted by the operator summarily, pursuant to 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).

With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are excluded from compliance with the requirements of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit behavior as specifically specified in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit behavior created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.
